International Classifications of Industrial Property Subject Matter

The International Classifications of industrial property subject matter (hereinafter referred to as the International Classifications) have been established by the respective international agreements.

In spite of the fact that for a long period Ukraine had not been a member state to the international agreements concerning the International Classifications, they have been translated into Ukrainian and used in Ukraine as one of the basic reference and search tool to patent documentation collections.

It is thanks to the translation of the International Classifications from English into Ukrainian that the corresponding provisions of the Decrees of the Verkhovna Rada of Ukraine of December 23, 1993 ¹¹. 3769-3771, in particular on creating before July 1, 1997 Ukrainian-language reference and search tools, have been fulfilled.

The International Classifications used in the world system of the legal protection of intellectual property rights are as a rule revised every five years and amendments and supplements are included in their published updated editions to enhance their search efficiency and to take account of the technical progress.

In view of these revisions, updating of the Ukrainian-language versions of the International classifications is carried out.

An important benchmark of state significance achieved in 2009 was the accession of Ukraine to most of the international agreements concerning the International Classifications of industrial property subject matter, in particular:

  • The Strasbourg Agreement concerning the International Patent Classification ratified by the Law of Ukraine of 17.12.08 ¹683-VI. The Agreement is coming into force in Ukraine on April 7, 2010.
  • The Locarno Agreement establishing the International Classification for Industrial Designs ratified by the Law of Ukraine of 17.12.08 ¹684-VI. The Agreement came into force in Ukraine on July 7, 2009.
  • The Vienna Agreement establishing the International Classification of the Figurative Elements of Marks ratified by the Law of Ukraine of 18.02.09 ¹1000-VI. The Agreement came into force in Ukraine on July 29, 2009.

It is worth mentioning that the Nice Agreement concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks was ratified much earlier by the Law of Ukraine of 01.06.2000 ¹1762-III. The Agreement came into force in Ukraine on December 29, 2000.

Ukraine’s accession to the mentioned international agreements enables our country to not only use the International Classifications but also to actively participate in their enhancement.

The current editions of the International Classifications translated into Ukrainian, published in print and used as a basis for electronic versions complete with search systems are listed below.

International Patent Classification

International Patent Classification. Main Groups (2011.01) – IRS (Information and Reference System) – accessible free of charge.

List of valid symbols of IPC-2011.01 used for classifying national patent documents in Ukraine as of 1 January, 2011.

International Classification of Goods and Services for the Purposes of the Registration of Marks (the Nice Classification). Ninth Edition. Second, Amended Edition" was published as an appendix to the Official Bulletin “Promyslova Vlasnist” (Industrial Property) ¹ 14/2008 on paper carrier.

An IRS "International Classification of Goods and Services for the Purposes of the Registration of Marks (the Nice Classification). Ninth Edition. Second, Amended Edition" has been launched. The IRS is accessible free of charge.

An ISS “The Ninth Edition of the Nice Classification” on CD-ROM has been created. This ISS is an electronic copy of the official Ukrainian-language translation of the ninth edition of the International Classification of Goods and Services for the Purposes of the Registration of Marks (second, amended edition) complete with search and navigation tools.

International Classification of the Figurative Elements of Marks

An IRS "International Classification of the Figurative Elements of Marks (the Vienna Classification). Sixth Edition" has been created. The text of the classification is presented together with its translation into Ukrainian. The IRS is accessible free of charge.

International Classification of Industrial Designs

“International Classification of Industrial Designs (Locarno Classification). Ninth Edition” translated into Ukrainian was published as an appendix to Official Bulletin “Promyslova Vlasnist” (Industrial Property) ¹ 21/2008 on paper carrier.

An IRS “International Classification of Industrial Designs (Locarno Classification). Ninth Edition” has been created. The IRS is accessible free of charge.

An ISS "Locarno Classification. Ninth Edition" on CD-ROM has been created. This ISS is an electronic copy of the official Ukrainian-language translation of the ninth edition of the International Classification of Industrial Designs complete with search and navigation tools.
